Privacy Policy


1. Introduction

Thank you for visiting cloud.tv and, if applicable, choosing to use our App or Apps. This Privacy Policy, like our Terms of Service, is an integral part of using our service, and you must completely agree to it as a condition of using our Site, Service, and Apps.

 

2. Definitions

Throughout this Agreement, we may use certain words or phrases, and it is important that you understand the meaning of them. The list is not all-encompassing and no definition should be considered binding to the point that it renders this Agreement nonsensical:

“App” or “Apps” refers to one or more of our applications, whether or not we have named such applications in our Terms of Service or Privacy Policy, or have made such applications available at the time of the acceptance of our Terms of Service and Privacy Policy (we may introduce new apps which are also covered by this Privacy Policy);

“Cloud TV” or “cloud.tv” refers to one or a combination of our company (Cloud TV, Inc.), our Site (cloud.tv), or our Service (including our Site and apps), depending on the context of the usage;

“Privacy Policy” means this Privacy Policy provided by Cloud TV, Inc.;

“Service” refers to the services that we provide, including our Site and our Apps;

“Site” refers to our website, cloud.tv;

“User” refers to you, those who use our Services, and general visitors to our Site;

“You” refers to you, the person who is reading this Privacy Policy.

 

3. Information Collected

Identifying Information Collected by Us

When you sign up for our Service, you may have information collected by the third party app store that provides you with a copy of our App or Apps, but we will not collect that information. Our App does, however, require that you give it certain permissions to access your third party social media accounts in order to provide data to you, but we do not actively collect that information. Our App does have access to such information, though, and we may elect to access it for the purpose of enforcing our Terms of Service or Privacy Policy, or assisting law enforcement or a bona fide plaintiff or applicant in a civil action or application.

Non-Identifying Information

Whenever you visit our Site, we may collect non-identifying information from you, such as your IP address, referring URL, browser, operating system, cookie information, and Internet Service Provider. Without a subpoena, voluntary compliance on the part of your Internet Service Provider, or additional records from a third party, this information alone cannot usually be used to identify you.

Restrictions on Access by Minors

We reiterate our information collection requirements as stated in our Terms of Service:

As we are located in the United States, and the services which our App can be used in conjunction with collect information from Users, the Children’s Online Privacy Protection Act applies to us, meaning that if you are under thirteen years of age, you are not permitted to use our Service, regardless of whether you live in the United States or elsewhere. We apologize for any inconvenience that this may cause.

 

4. Use and Sharing of Your Information

4.1. Use of Your Information

Your information may be used to personalize your App and/or display contact-based statistics in particular widgets in our Apps. In addition, in any instance where you provide us with your information (such as by e-mailing us), we may use your personal information, suggestions, complaints, and other information provided to:

  • To enhance or improve Users’ experiences, our Site, or Service.
  • To send e-mails about our Site or respond to inquiries.
  • To share with Facebook, Twitter, Flickr, or other third parties, with your consent. You hereby agree that we may, without seeking further consent, share your information with third party social media and other websites.
  • To respond to inquiries from billers, such as Amazon, Barnes & Noble, and Google.
  • To assist law enforcement or private persons with bona fide legal complaints against you.

4.2. Sharing of Your Information with Third Parties

Information sharing is essential for our social media Apps and any other App that we connect to a third party. We may, and you agree that we may share your information with Instagram, Tumblr, Facebook, 500px, Flickr, Picasa, and Twitter, as well as any other third party service that we deem relevant.

 

5. Accessing, Editing, and Removing Your Information

Information that you upload to social media and other websites through our Service is controlled by those third party websites rather than Cloud TV, Inc. Depending on the third party, you may in some cases be able to review and edit the personal information you have uploaded. Although changes, if permitted, may occur immediately, information may still be stored in a web browser’s cache. Additionally, another person may save the information before you are able to edit or remove it. We take no responsibility for stored information in your cache, or in other devices that may store information, or for copied information or information which a third party refuses to edit or remove, and we disclaim all liability of such. You should carefully review the Privacy Policy and other legal documents governing your use of any third party service before you use our Apps to submit information to them.

 

6. Cookies

We may use cookies to save your preference or for other standard purposes when operating our website. For these reasons, you must have cookies enabled in your browser to use our Site and Services.

Please note that disabling cookies in general may cause certain services of ours to not function properly or not function at all. It may also interfere with other websites unrelated to Cloud.tv or its Apps that you may visit.

 

7. Third Parties

7.1. Third Party Websites

Cloud.tv may post links to third party websites on its Site or within its Apps, which may include information that we have no control over. Whether you access third party websites through a link on our Site, or as a consequence of using our Service, you acknowledge that you are aware that these third party websites are not screened for privacy or security issues by us, and you release us from any liability for the conduct of these third party websites.

Please be aware that this Privacy Policy, and any other policies in place, in addition to any amendments, does not create rights enforceable by third parties. Cloud TV, Inc. bears no responsibility for the information collected or used by any advertiser or third party website. Please review the privacy policy and terms of service for each site you visit through third party links or through our Service.

7.2. Purchases

Purchases of our Apps are conducted using third party app sales services, such as Amazon, Barnes & Noble, and Google. These services may request that you provide certain sensitive financial information, such as credit card information, in order to complete transactions. Although these services have a good reputation, we cannot provide any assurances about the security of these websites at any given time, and recommend that any User who engages in online purchasing conduct routine credit bureau checks and take other measures to ensure that their financial information has not been compromised.

 

8. Third Party Access to Your Information

Although you are entering into an agreement with Cloud TV, Inc. to disclose your information to us, we do use third party individuals and organizations to assist us, including contractors, web hosts, and others.

Throughout the course of our provision of our Services to you, we may delegate our authority to collect, access, use, and disseminate your information. For example, our web host stores the information that you provide us, and we may hire third parties to assist us in maintaining, repairing, improving, or otherwise assisting us with our Site and Services.

It is therefore necessary that you grant the third parties we may use in the course of our business the same rights that you afford us under this Privacy Policy. For this reason, you hereby agree that for every authorization which you grant to us in this Privacy Policy, you also grant to any third party that we may hire, contract, or otherwise retain the services of for the purpose of operating, maintaining, repairing, or otherwise improving or preserving our website or its underlying files or systems. You agree not to hold us liable for the actions of any of these third parties, even if we would normally be held vicariously liable for their actions, and that you must take legal action against them directly should they commit any tort or other actionable wrong against you.

9. Law Enforcement

You agree that we may disclose your information to a third party where we believe, in good faith, that it is desirable to do so for the purposes of a civil action, criminal investigation, or other legal matter. In the event that we receive a subpoena affecting your privacy, we may elect to notify you to give you an opportunity to file a motion to quash the subpoena, or we may attempt to quash it ourselves, but we are not obligated to do either. We may also proactively report you and release your information without receiving any request to third parties where we believe that it is proper to do so for legal reasons, such as instances where we believe your publications violate any law of the United States or any other country having jurisdiction over us, our Site, Services, or our Terms of Service. You release us from any damages that may arise from or relate to the release of your information to a request from law enforcement agencies or private litigants. We may release your information under the conditions listed in this paragraph whether it is to individuals or entities in the State of California, the rest of the United States, or elsewhere.

 

10. Commercial and Non-Commercial Communications

By providing information to the Site that forms the basis of communication with you, such as contact information, you waive all rights to file complaints concerning unsolicited email from us since, by providing such information, you agree to receive communication from us other anyone else covered under this Privacy Policy. However, you may unsubscribe from certain communications by notifying Cloud TV, Inc. that you no longer wish to receive solicitations or information and we will endeavor to remove you from our database where you have the right to request this under our Agreement, Privacy Policy, or applicable law, or where we voluntarily decide to grant the request.

 

11. Security Measures

We may take certain measures to enhance the security of our Site and Services. However, we make no representations as to the security or privacy of your information. It is in our interest to keep our website secure, but we recommend that you use anti-virus software, routine credit checks, firewalls, and other precautions to protect yourself from security and privacy threats.

 

12. Children’s Online Privacy Protection Act

We prohibit minors under the age of thirteen from using our Site and Service, including our Apps. If you become aware of a minor who is using our Site or Service in violation of this rule, please contact us immediately with full details at hi@cloud.tv, including information sufficient to identify the User and explain why you believe the User is under the required age.

If you are a User who is subject to such a report, or we have other reason to suspect that you are below the required age, we may demand additional information from you, such as copies of government identification to establish your age and identity, and we may choose to disable your access to our Site or Service, including but not limited to terminating your App functions remotely or, if we are unable to do so, demanding that you cease using the App, until you comply with such a demand.

 

13. Your California Privacy Rights

Cloud TV, Inc. permits residents of the State of California to use its Service, and complies with the California Business and Professions Code §§ 22575-22579. If you are a California resident you may request certain information regarding our disclosure of personal information to any third parties for their direct marketing purposes. Various provisions throughout this Privacy Policy address requirements of the Californian privacy statutes. In summary, you must presume that we collect electronic information from all visitors. 14. International Transfer

Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Cloud TV, Inc. may transfer personal information to the United States or elsewhere and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

 

15. Amendments

Like our Terms of Service, we may amend this Privacy Policy from time to time. When we amend this Privacy Policy, we will place a note on our Site as to when the Privacy Policy was last modified, and e-mail you about it. You must agree to the amendments as a condition of your continued use of our Site and Service. If you do not agree, you must immediately cease using our Site and Service, including Apps for which you have previously paid, and notify us of your refusal to agree by e-mailing us with details sufficient to identify you and terminate your Service at hi@cloud.tv.
